Effective September 24, 2026. Version 2026-09-24.
First version for this product.
DealerAnswer is an AI front desk for powersports dealerships, owned and operated by Gossip Apps LLC, a Texas limited liability company (we, us, our). These Terms of Service (Terms) cover dealeranswer.com and the DealerAnswer web app (together, the Service). Our Privacy Policy and any product-specific policy we publish for DealerAnswer are part of these Terms.
You accept these Terms by creating an account, checking a box that says you agree, paying for the Service, or using the Service after the effective date above. We record the version of these Terms you accepted, when you accepted it, and the IP address you accepted it from.
Children. The Service is not directed to children. We do not knowingly collect personal information from anyone under 13, as required by COPPA, and we do not allow anyone under 18 to use the Service. If we learn a person under 18 has an account, we delete the account and the data tied to it. A parent or guardian who believes their child has used the Service can write to [email protected].
We may change, add to, or discontinue features of the Service at any time. If we make a material change to these Terms, we will notify you by email or inside the product at least 14 days before the change takes effect, except for changes required by law or changes that only add new features, which take effect as soon as we post them. Using the Service after a change takes effect counts as accepting it. If you do not agree with a change, stop using the Service and close your account.
DealerAnswer stores lead records, conversation history from your web chat widget, texts, and calls, appointment bookings, and reports that you and your team generate through the Service (Your Content). You and your dealership own Your Content. You grant DealerAnswer a worldwide, non-exclusive, royalty-free license to host, store, back up, reproduce, and display Your Content solely to operate, secure, and support the Service for you and the users you authorize, and to send it to the sub-processors named in our Privacy Policy who help us run the Service, including the AI providers in Section 24. We do not use Your Content to advertise or promote anything, and we do not use it to train AI models.
You represent that you have the right to put Your Content into the Service and that doing so does not break the law or anyone else's rights. This license lasts as long as we need it to provide backups and support, and ends on the schedule in Section 18 and in our Privacy Policy once your account closes.
You may not use the Service to:
Section 23 below covers the extra rules that apply to the texts and calls you send your own leads and customers through the Service, and Section 24 covers the AI features.
DealerAnswer is an interactive computer service under 47 U.S.C. 230. We have no general obligation to monitor Your Content, but we may review it. We can remove content, restrict features, or suspend or terminate an account at our discretion, with or without notice, if we believe these Terms or the law has been broken. Report a problem to [email protected]. We may preserve and disclose content to comply with the law, enforce these Terms, or protect people, and we cooperate with law enforcement. We enforce a repeat infringer policy for copyright claims.
Our designated agent for copyright notices is DealerAnswer, DMCA Agent, [email protected]. A takedown notice must include the elements listed in 17 U.S.C. 512(c)(3). If your content is taken down, you can send a counter notice under 17 U.S.C. 512(g). We may forward notices and counter notices to the parties involved, and we terminate repeat infringers. Knowingly misrepresenting a claim can create liability under 17 U.S.C. 512(f). Send trademark complaints to the same address.
We use the sub-processors named in our Privacy Policy to run the Service, including DigitalOcean, Cloudflare, Resend, Twilio, Anthropic, ElevenLabs, and Stripe (Stripe Services Agreement applies to payments). We are not responsible for third-party sites or services you connect to DealerAnswer, and their own terms apply to your use of them.
DealerAnswer is billed per store, per month, with no long-term contract. As of the effective date above, the plans are Starter at $299 a month (500 texts and 60 AI voice minutes included), Growth at $799 a month (2,000 texts and 300 AI voice minutes included), and Pro at $1,299 a month (8,000 texts and 1,200 AI voice minutes included, plus the group dashboard); every plan includes unlimited staff seats. New stores get 30 days free before the first charge. Current prices and plan details are always shown on the Price page and at checkout.
If you go over your plan's included texts or AI voice minutes, the AI keeps working rather than dropping a customer, unless you turn overage off in Billing. Overage is billed at $0.25 per extra AI voice minute and $0.02 per extra text on your next Stripe invoice. If you turn overage off, the AI voice agent stops taking new calls and texts stop once you reach the allowance, and service resumes at the next billing period; missed-call text-back keeps working either way.
Prices are in US dollars and include any tax we are required to collect. Stripe processes card payments and we never store your full card number. Subscriptions auto-renew until you cancel; you can cancel any time and keep access through the end of the period you already paid for; we do not give partial-period refunds. We give at least 30 days notice before a price change. A failed payment may suspend paid features, and a chargeback may lead to account suspension. Before we charge you for the first time, we show you the price and get your clear consent, and cancellation is always available in the product or by email, consistent with the ROSCA auto-renewal rules.
The Service, our software, our trademarks, and everything we create for the Service belong to DealerAnswer or our licensors. We give you a limited, revocable, non-transferable license to use the Service for your own dealership. You may not scrape or copy our content. Open-source components we use remain under their own licenses.
The Service is provided AS IS and AS AVAILABLE. We do not promise the Service will be error-free, uninterrupted, accurate, or fit for a particular purpose. AI-generated replies and voice calls can be wrong; see Section 24. We do not endorse anything a lead or customer sends through the Service.
To the extent the law allows, DealerAnswer is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the Service. Our total liability for any claim is capped at the greater of what you paid us in the 12 months before the claim, or 100 US dollars. This limit does not apply where the law does not allow it, such as for gross negligence, willful misconduct, or death or personal injury.
You agree to defend and indemnify DealerAnswer and its members, officers, and contractors against claims arising from Your Content, your use of the Service, or your breach of these Terms.
DealerAnswer is a business product. Any dispute between you and DealerAnswer will be decided by the state and federal courts sitting in Victoria County, Texas, and both sides waive the right to a jury trial. A claim must be brought within one year of when it arose.
Texas law governs these Terms, without regard to conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Consumers keep any non-waivable rights of their home jurisdiction.
You can close your account any time from inside the product or by emailing [email protected]. We can suspend or terminate your account for breaking these Terms, for risk or legal reasons, or if the account has been inactive for more than 24 months. When your account ends, your license to use the Service ends and we delete Your Content within 30 days, subject to the retention periods in our Privacy Policy. Sections that by their nature should survive termination will survive.
DealerAnswer. Legal notices, privacy requests, and DMCA notices: [email protected].
DealerAnswer answers your dealership's leads. It runs a web chat widget on your site, a shared lead inbox, automatic text-back for missed calls, AI-drafted and AI-sent text replies, an AI voice agent that can answer and place calls, appointment booking, and a daily report of the day's activity.
When you use DealerAnswer to store and message your own leads' and customers' personal data, such as names, phone numbers, call recordings and transcripts, chat and text messages, and appointment details (Customer Data), you are the controller of that data and DealerAnswer is the processor, acting only on your instructions. We process Customer Data for one purpose: to provide, secure, and support the Service. We never use it for our own purposes and never use it to build a dataset.
We use the sub-processors named in our Privacy Policy, currently DigitalOcean, Cloudflare, Resend, Twilio, Anthropic, ElevenLabs, and Stripe, to help us run the Service, and we remain responsible for their handling of Customer Data under this agreement. If your account is terminated, we delete Customer Data within 30 days, except where we are required to keep records longer by law (see Retention in our Privacy Policy). If we learn of a security incident affecting Customer Data, we will notify you without undue delay. We do not sell Customer Data and we do not share it with anyone except the named sub-processors, as the law requires, or with your direction.
You are responsible for making sure the texts and calls you send through DealerAnswer comply with the law. Before DealerAnswer texts one of your leads or customers, you must have a lawful basis to contact them under the Telephone Consumer Protection Act (TCPA). DealerAnswer automatically honors STOP, STOPALL, and UNSUBSCRIBE replies and stops texting that person further; you may not attempt to bypass this. Any email you send through DealerAnswer must follow the CAN-SPAM Act. Breaking these rules is a breach of these Terms and can lead to your account being suspended or terminated.
DealerAnswer's text replies and voice agent are generated by AI. AI-generated replies and voice conversations can be wrong, incomplete, or say something you would not have said yourself. You are responsible for reviewing what the AI sends on your behalf and correcting it, and you can take over any conversation from the inbox or the phone app at any time.
Text replies are generated using Anthropic's Claude models. The voice agent uses ElevenLabs for speech. Content you or your customers send to these features is processed by Anthropic and ElevenLabs under our agreements with them, and is not used to train their models.
